Court asks chief ministers to settle phone-tapping issue

New Delhi: The Supreme Court Friday disapproved of the manner in which the Uttar Pradesh and Delhi governments were fighting each other on the telephone tapping incident involving Samajwadi Party leader Amar Singh and asked the chief ministers of the two states to discuss and resolve the matter.

A bench of Chief Justice Y.K. Sabharwal and judge C.K. Thakker asked the chief ministers to resolve the ongoing tussle regarding investigations. The bench hoped that none of the parties would precipitate the matter, pending such talks.

The bench was hearing the special leave petitions (SLPs) filed by the Uttar Pradesh government challenging the territorial jurisdiction of Delhi High Court in entertaining petitions in the telephone tapping case and issuing contempt notice to the Special Task Force.

The bench issued notice to the Delhi government on the SLPs and said this litigation between the two states in high court and the apex court was unfortunate. It noted that the matter should have been sorted out at the highest level. In the process, senior civil servants holding sensitive positions were dragged into the incident.

Appearing for the Uttar Pradesh government, senior counsel K.T.S. Tulsi alleged that the Delhi Police was actively involved in the crime and wanted to shield the real culprits. He said he had no objection if the investigation was entrusted to an independent investigating agency other than the police of both the states.

After years of legal wrangling, a designated court in Ghaziabad has framed charges against former Uttar Pradesh Chief Secretary and Chief Executive of NOIDA Neera Yadav and two others for alleged bunglings in allotment of land.
